Fed threat gets results as Calif pot shops close

Cities are now turning to the Feds for help with shutting down dispensaries in their area instead of trying to regulate and tax them. They continue to turn away Medical Marijuana Patients to street dealers to obtain their medication.

LAKE FOREST, Calif. (AP) — A letter from federal prosecutors accomplished what nearly $600,000 in legal fees couldn't do in this Orange County suburb: it shut down medical marijuana shops.
 
Two weeks after California's four U.S. attorneys announced they were cracking down on dozens of operations across the state growing and selling medical pot illegally, all eight collectives that occupied the second floor of a Lake Forest mini-mall have closed.
 
Across the Central District of California, which stretches from Santa Barbara to San Bernardino counties, many of the 38 clinics have closed because landlords, threatened with criminal charges or seizure of their assets, were given just 14 days to evict their clients, a period that expires Friday. Other districts in California gave pot dispensaries more time to comply.
 
Some smaller California communities like Lake Forest have struggled in recent years to regulate the clinics, while others have banned pot shops altogether. Cities such as Los Angeles and San Jose have sought to rein in a large number of collectives that have cropped up. The fight has cost local municipalities millions of dollars in legal fees as it has shifted between city halls and courtrooms.

DUI law regarding marijuana unconstitutional

Being charged for DUI just becuase they find trace amounts of marijuana in your system that could of been from weeks or months ago is 100% unconstitutional in our eyes. If you smoked a joint 2 weeks ago and got into a car accident tomorrow, how would that be fair to be charged for a DUI becuase you still had traces of Cannabis in your system? Well it's bullshit and we hope the Judge will agree!

ST. CHARLES TOWNSHIP – A judge will rule next week whether a woman accused in the 2009 traffic crash that killed a St. Charles couple can legally be charged with aggravated driving under the influence  because she had marijuana in her system at the time of the crash.
 
On Thursday, a lawyer for defendant Alia Bernard and prosecutors argued the matter before Kane County Judge Allan Anderson. Bernard, 27, of Aurora, has pleaded not guilty to charges of reckless homicide and aggravated DUI. The charges stem from a May 23, 2009, traffic crash on Route 47 at Smith Road near Elburn that resulted in a multi-vehicle pileup in which motorcyclists Wade and Denise Thomas, of St. Charles, died. She was charged with aggravated DUI after prosecutors said tests revealed she had consumed marijuana. Under Illinois law, anyone who consumes marijuana and was involved in a crash can be charged with DUI. And if someone dies in the crash, the charge can be upgraded to aggravated DUI.
 
However, Bernard’s lawyer, Bruce Brandwein, said Bernard was not impaired at the time of the crash, and prosecutors have not disputed that assertion. Brandwein has asked the court to declare that portion of the DUI statute unconstitutional and dismiss the aggravated DUI charge against Bernard. He argued in a motion filed in August and in oral arguments in court Thursday that the law, by specifically singling out drivers who consume marijuana “unlawfully,” creates a distinction that cannot pass the test of equal protection under law.
 
For instance, he notes that the law would not allow charges of aggravated DUI to be brought against a motorist in Illinois who has consumed marijuana in a state in which it is lawful to do so, but whose driving is not impaired by the use of the drug

Canadian Researchers to Prove Marijuana Medicinal Use

Though cannabis is a useful medicinal plant, it is often disrespected for its ill uses. But, two Canadian researchers are determined to change the stigma by carrying out a research in which they are studying the cannabis genome. The only method to study it is to sequence them.
 
How many dozens of studies proving Cannabis has medicinal value are going to have to be released before the government will recognize these results and re classify Cannabis from a schedule 1 drug to something more realistic...?
 
The research is expected to get finished by Thursday and then, it would be published in the open access journal Genome Biology. Both the researchers, Jon Page from the University of Saskatchewan and Tim Hughes from the University of Toronto have chosen one of the two varieties of cannabis, marijuana to prove the above.
 
Page who is plant biochemist and Hughes, who is molecular biologist, has become first researchers to study the genomes of cannabis, by sequencing them. And, marijuana has become the maiden medicinal plant to be sequenced, and all over, 22nd plant to be sequenced.
 
Cannabis comes in two types, hemp and marijuana. Researchers are working their best to make marijuana included in the legally allowed medicinal plants of Canada. While doing the research, they found that it is the farmers, who make marijuana, a drug component.
 
There are number of uses of marijuana, but people often associate with illegal drug, as they are unaware of its medicinal plant. Between marijuana and hemp, former one is stronger than latter in relation to the presence of THC, a metical component. Taking it as an opportunity, farmers rather toning its effect down, they elevates its effect by bring change in its molecular structure.
 
Hemp has lesser amount of THC, and could be used in making ropes, fiberglass, plastic material, which could be used in manufacturing of cars, and could also be used in making bricks.
 
Both the researchers are hoping that soon their reassert should be considered, and its medicinal use could be allowed for chronic diseases.
