No medical marijuana patient’s garden was too small for Asa Hutchinson. Under Hutchinson, who served as the administrator for the DEA under George W. Bush from August 2001 to January 2003, the nation’s drug cops raided cannabis grows with as few as six plants.

Once the windowsill-sized gardens were wiped out, their gardeners went to prison—even if they were demonstrably sick medical marijuana patients, and even if it required some legal trickery.

To trigger plant-count-based mandatory minimums, Justice Department prosecutors would add up the number of marijuana plants grown over a period of several years. This meant growers in California could be in constant compliance with state law, but if they grew 33 plants a year for three years or more, it meant prison time in a federal bust.

Oregon Lawmakers Push to Protect Pot Users’ Info from U.S.

SALEM, Ore. (AP) — Oregon lawmakers worried about a nationwide crackdown on legal marijuana under President Donald Trump’s administration are rushing to protect the personal information of pot customers in case federal agents try to seize it.

A bipartisan group of lawmakers is taking one of the first direct state actions in response to White House spokesman Sean Spicer last week suggesting a boost in enforcement of federal anti-marijuana laws.

U.S. Attorney General Jeff Sessions said this week that the Justice Department is reviewing an Obama-era memo giving states flexibility in passing marijuana laws.

Bills to Legalize Medical Cannabis Introduced in South Carolina

Companion bills to legalize medical cannabis introduced in South Carolina.

Senator Tom Davis and Representative Peter McCoy held a press conference to formally announce the companions bills that will be filed simultaneously in the state’s House and Senate.

If approved into law, the South Carolina Compassionate Care Act would allow those with a recommendation from a physician to possess and use cannabis and cannabis products, given they have a qualifying condition.

Qualifying conditions include glaucoma, cancer, hepatitis C, amyotrophic lateral sclerosis, Crohn’s disease, HIV/AIDs, ulcerative colitis, agitation of Alzheimer’s disease, PTSD, autism, idiopathic pulmonary fibrosis, Parkinson’s disease and neural-tube defects.
