How Will The Feds React If Colorado Passes Marijuana Legalization Measure Amendment 64?

Washington and Oregon both have measures similar to Colorado’s Amendment 64 on the ballot this year. It is unknown how the federal government will respond if any or all of them pass. The feds could respect the decision of voters, they could try to block implementation of some parts of the law, or they could shut down dispensaries and arrest people involved in the wholesale and retail ends of the business.
 
While no one can say what the feds will do if 64 passes, they have not completely looked the other way on medical marijuana. In Colorado, the Department of Justice has forced at least 23 medical marijuana dispensaries to close or to move at least 1000 feet away from any educational facility. In California and Montana the DOJ has gone even further, targeting businesses regardless of their distance from schools.
 
One thing that is clear is that even if Amendment 64 passes, marijuana possession will remain illegal under federal law. Possessing even one joint of marijuana is a misdemeanor punishable by up to a year in prison and a $1000 fine. A second possession conviction carries a mandatory sentence of 15 days.
 
It is in growing your own, though, where the difference between state and federal law will become stark if 64 passes. State law would allow someone to grow six plants and to possess all of the harvest. Federal law says even one plant is a felony, punishable by up to five years in prison and a fine of up to $250,000.
 
Paul Roach, spokesperson for the DEA, said the DEA does not have a position on the amendment. If it passes, Roach said the DEA will continue to enforce federal drug laws. “We don’t see that changing,” he said.
 
Local spokesperson for the Department of Justice, Jeff Dorschner, said “We don’t know what will happen if it passes. There are a variety of options, none of which I can discuss.”

L.A. City Council Votes to Overturn Medical Marijuana Dispensary Ban

On Tuesday the Los Angeles City Council voted 11-2 to repeal its recent ban on medical marijuana dispensaries, averting a ballot showdown with advocates over the issue.

 

The vote leaves Los Angeles, once again, without any law regulating medical marijuana dispensaries. But that does not necessarily mean dispensaries will be allowed to stay open.

 

Council members say they are hoping that a new federal crackdown on L.A. dispensaries may accomplish what they hoped to achieve with their ban. “That is our relief,” Councilman Jose Huizar said of the federal action, which began last week with raids on several dispensaries. Dozens of other pot shops were sent letters, ordering them to close.

 

The L.A. City Council is always in favor of others doing their job for them. At some point they have to realize that they need to come up with a set of reasonable regulations for dispensaries in the city.

 

City officials may also seek to shut down dispensaries on their own by prosecuting operators for violating city land use laws.

 

The battle over dispensaries is far from over in Los Angeles, but the council is on the ropes.

NY Medical Marijuana Testimonial from Dr. Kevin Smith

There is no way to know how many people – like Dr. Smith – live in pain instead of breaking of the law. Or settle for dangerous and addictive prescription pills and treatments rather than risk the wrath of law enforcement.

 

How can anyone watch the video below and not be moved? This man is not a “stoner.” He is someone who was dealt an awful hand by life and still has reached incredible heights. He is a doctor. Yet he is not allowed to choose cannabis to treat his ailment. He is more than qualified to make that decision, yet he does not even have the option in New York.

 

The freedom he experienced in a foreign land is denied to him in the “land of the free.” He is allowed to prescribe pills to people that can possibly kill them, but he can’t prescribe marijuana to them or himself.

 

Do we even deserve the title “land of the free” anymore?
