Massachusetts legislators to weigh medical marijuana at Statehouse hearing

BOSTON – Doctors, parents and advocates are expected to square off at the Statehouse on Tuesday over a proposed statewide ballot question that could legalize the medical use of marijuana in Massachusetts.
The Joint Committee on Public Health will hold a public hearing on a bill that mirrors the ballot question on medical marijuana. A copy of the ballot question can be accessed through this link.
If the proposed law for the medical use of marijuana appears on the Nov. 6 ballot and is approved by a majority of voters, on Jan. 1 Massachusetts would join 16 other states with a law permitting the use of the plant for medical purposes.
The proposed law would allow a physician to prescribe a 60-day supply of marijuana to a patient with a "debilitating medical condition," such as cancer, AIDS, Parkinson's disease or a broad category that includes "other conditions." The law would permit up to 35 nonprofit dispensaries or treatment centers around the state, including at least one in each county.

Feds: Sick not in our sights, but growers are

Cancer patients don’t have to fear a knock on the door from feds toting guns and search warrants should the Massachusetts Legislature or voters legalize medical marijuana this year — but White House and U.S. Department of Justice officials tell the Herald they won’t turn a blind eye to others who break federal laws, including doctors and state-sanctioned treatment centers.
“Marijuana is against federal law and, as you know, that is what we enforce,” said Kevin Lane, acting special agent in charge of the U.S. Drug Enforcement Administration’s New England Division. “DEA has never targeted the sick or dying. Cultivation of marijuana is against federal law and if organizations or groups choose to cultivate marijuana they will be subject to arrest.”
President Obama, criticized for recent federal raids on medical marijuana dispensaries in California, believes “that while the prosecution of drug traffickers is a core priority, targeting individuals with cancer and serious illnesses is not the best allocation of federal law enforcement resources,” said a White House official. Republican front-runner Mitt Romney’s campaign did not respond to requests for comment.
U.S. Attorney Carmen Ortiz said, “While this office does not intend to focus its limited resources on seriously ill individuals who use marijuana as part of a medically recommended treatment program in compliance with state law, individuals and organizations who are in the business of cultivating, selling or distributing marijuana, and those who knowingly facilitate such activities, will be in violation of federal law and be subject to federal enforcement.”
